Terms of Service

Welcome to Habitability! These Terms of Service ("Terms") govern your use of the Habitability mobile application ("App") operated by Athreya Anand ("we," "us," or "our").

By downloading, installing, or using Habitability, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Eligibility

You must be at least 13 years old to use Habitability. By using the App, you represent that you are at least 13 years of age.

2. Account Registration

To use certain features of Habitability, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Promptly update your information if it changes
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

You may create only one account per person. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscriptions and Payments

Pricing

Habitability offers premium features through paid subscriptions:

  • Monthly: $4.99 USD per month
  • Annual: $19.99 USD per year

Prices are subject to change with reasonable notice.

Billing

  • Subscriptions are billed through the Apple App Store or Google Play Store
  • Payment is charged to your app store account at confirmation of purchase
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period

Cancellation

  • You may cancel your subscription at any time through your app store account settings
  • Cancellation takes effect at the end of the current billing period
  • You will retain access to premium features until the end of your paid period

Refunds

Refund requests are handled by the Apple App Store or Google Play Store according to their respective policies. We do not process refunds directly.

4. User Content

Your Content

You retain ownership of the content you create in Habitability, including:

  • Habit names and descriptions
  • Profile information
  • Messages and nudges to friends

License to Us

By creating content in Habitability, you grant us a limited license to store, display, and process that content solely to provide the App's services.

Content Guidelines

You agree not to create content that:

  • Is illegal, harmful, or offensive
  • Infringes on others' intellectual property rights
  • Contains malware or malicious code
  • Harasses, threatens, or bullies others
  • Impersonates another person or entity

We reserve the right to remove content that violates these guidelines.

5. Acceptable Use

You agree to use Habitability only for lawful purposes. You will not:

  • Violate any applicable laws or regulations
  • Interfere with or disrupt the App's operation
  • Attempt to gain unauthorized access to any systems
  • Use the App to send spam or unsolicited messages
  • Reverse engineer, decompile, or disassemble the App
  • Use automated systems to access the App without permission
  • Circumvent any security measures or access restrictions

6. Social Features

Habitability includes social features that allow you to connect with friends. By using these features, you agree to:

  • Respect other users' privacy and boundaries
  • Not send harassing or inappropriate messages
  • Use nudges and messages constructively
  • Report any abusive behavior to us

7. Intellectual Property

Our Rights

Habitability and its original content, features, and functionality are owned by Athreya Anand and are protected by international copyright, trademark, and other intellectual property laws.

Feedback

If you provide us with feedback or suggestions about the App, you grant us the right to use that feedback without compensation or attribution.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Disclaimers

"As Is" Service

Habitability is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of content

No Guarantees

We do not guarantee that:

  • The App will be uninterrupted or error-free
  • Defects will be corrected
  • The App is free of viruses or harmful components
  • The results of using the App will meet your expectations

10. Limitation of Liability

To the maximum extent permitted by law, Athreya Anand shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, or goodwill
  • Service interruption
  • Computer damage or system failure
  • Cost of substitute services

Our total liability for any claims arising from your use of Habitability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Athreya Anand from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

  • Your use of Habitability
  • Your violation of these Terms
  • Your violation of any third-party rights

12. Termination

By You

You may terminate your account at any time by deleting your account through the App's settings.

By Us

We may suspend or terminate your access to Habitability at any time, with or without cause, with or without notice, including if we believe you have violated these Terms.

Effect of Termination

Upon termination:

  • Your right to use the App ceases immediately
  • We may delete your account and data
  • Provisions that should survive termination will remain in effect

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms in the App
  • Updating the "Effective date" at the top
  • Sending an in-app notification for significant changes

Your continued use of Habitability after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or your use of Habitability shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in California, and the arbitrator's decision shall be final and binding.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Athreya Anand regarding your use of Habitability.
